#### ABTA Members
We are a member of ABTA which means you have the benefit of ABTA’s assistance and Code of Conduct. Many of the travel arrangements that we sell are protected in case of the financial failure of the travel company. Please ask us about the protection that applies to your booking. #### ATOL Protection
Many of the flights and flight-inclusive holidays on this website are financially protected by the ATOL scheme. But ATOL protection does not apply to all holiday and travel services listed on this website. Please ask us to confirm what protection may apply to your booking. If you do not receive an ATOL Certificate then the booking will not be ATOL protected. If you do receive an ATOL Certificate but all the parts of your trip are not listed on it, those parts will not be ATOL protected. Our ATOL membership number is 1631.

It is a condition of booking that you must have suitable travel insurance. It is important that you purchase travel insurance that suitably covers your participation in whatever activities you may undertake at the time that you make your booking.

Ensuring that your holidays are adequately protected is one of our main priorities. That's why we have specifically chosen Holiday Extras as our preferred provider to ensure that you are protected before and whilst you are travelling. Our brochures are usually launched a minimum of six months before departure and in some cases even a year in advance.

### Flight Costs
All airlines have different levels of seat prices which are dependant on how far in advance of the departure date the seats are booked. The price increases as each block of seats is sold until the aircraft is full. Our brochure prices are based on the lowest seat prices and when these are sold our computer system will automatically search for the next level of fare available from that airline. This extra cost will be reflected in the price quoted to you by our reservations consultants or in your online booking. These different levels of seat prices can put as much as £200-£300 on the cost which is why our flight supplements are always quoted as “from” a particular figure and is why, at the time of booking, the price quoted may be higher than that in the brochure.

### Hotel Costs
Our hotel costs, on the other hand, do not vary according to the time you book your holiday as these have been contracted at fixed rates. As we buy our currency in advance we also do not charge any currency surcharges.

There are, however, instances where our special offers have run out due to high demand and in these instances you will be offered the same holiday without those special offers.

The offer that usually runs out first is that offering no single supplement. While we endeavour to satisfy our clients who seek the benefit of our offers, the supply is not limitless and they tend to sell out quickly.

Can I extend my balance due date?

The balance of your holiday is due 10 weeks before departure.

You can find the exact date on your confirmation invoice which would have been sent to you at time of booking via email or by post.

You can also find your balance due date on our website in the [My Booking](/my-booking) section.

If you gave us your email address at time of booking, we will also send you a balance reminder email a few weeks before it is due.

When is my balance payment due?

The balance of the cost of your holiday arrangements is due by the balance due date as notified to you and as stated on your booking confirmation.  

Balances are normally due ten weeks before departure but may be sooner for a River Cruise booking, please check your confirmation.

If the deposit or balance is not received by us in full by the applicable due date, we reserve the right to treat the booking as cancelled by you in which case we shall retain your deposit.

Paying your balance

Payments

Refunds are made in cash and will be processed within 14 days in accordance with the requirements under the Package Travel Regulations.  

We will refund you on the same payment card or by the same method that you used to pay us.

When will I get my refund?

Foreign, Commonwealth and Development Office (FCDO) advice relates to imminent departures. We make decisions as to whether holidays can continue on a rolling basis 5 days prior to departure. 

If the FCDO advise against all but essential travel to your destination and your departure date is 5 days or less then unfortunately your holiday is cancelled. In this event our Customer Experience team will contact you to discuss your options. Your options include:  

- Amending to a later period or alternative destination. Please note that the price of your holiday may be greater than or less than your existing holiday and you will be required to pay or be refunded the difference. Mercury Holidays does not charge amendment fees although supplier fees may apply. 
- Receiving a full cash refund within 14 days in accordance with the requirements under the Package Travel Regulations. 

Our Customer Experience team will contact you in priority of departure order, there is no need to contact us.

Refund Policies

We start planning the holidays many months in advance. Whilst it is unlikely that we will have to cancel your holiday or make changes to it, occasionally we may have to do so, and we reserve the right to do so at any time. We also reserve the right to make changes to or correct errors in our brochure, and on our website. Further, your flight details may change, or a hotel may close down. If we make an insignificant change to your holiday, we will make reasonable efforts to inform you or your travel agent as soon as reasonably possible if there is time before your departure but we will have no liability to you. Examples of insignificant changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same or higher standard, changes of carriers. Please note that carriers such as airlines used may be subject to change. We promise not to make any significant changes (as described below) to or cancel your confirmed holiday arrangements less than 28 days before departure, unless we are forced to do so as a result of force majeure (see clause 11). If we have to cancel or make a significant change to your arrangements, we will give you the following choices:

1) Accepting the changed arrangements as notified to you; or
2) Accepting an offer of alternative travel arrangements of a similar or higher standard to that originally booked if available with you paying an additional fee or receiving a refund in respect of any price difference 
3) Accepting an offer of alternative travel arrangements of a lower standard to that originally booked if available (with a refund in respect of any price difference) 
4) Cancelling or accepting the cancellation and receiving a full & prompt refund of all monies paid to us.

A significant change is a change made before departure which, on the basis of the information given to us by you at the time of making your booking, we can reasonably expect will have a major effect on your holiday. 

The following changes are examples of significant changes when made before departure:

- A reduction in the number of nights of your holiday
- A change of your outward departure time or overall length of your of arrangements of 12 or more hours
- A change from a day flight to night flight (providing time of departure is changed by more than 8 hours for shorthaul and 12 hours for longhaul). A night flight which is changed to depart after or before midnight is not a change of date. A change of overseas airport, return UK airport or return flight time of less than 12 hours will not be a significant change. Where your airport is changed we promise to transport you from your overseas accommodation to your alternative overseas airport or from your UK airport of arrival to your UK departure airport (except for changes made from/to: Gatwick/Heathrow/Stansted/Luton or Glasgow/Prestwick or Birmingham/East Midlands). 

The above sets out the maximum extent of our liability for changes and cancellations and we regret we cannot meet any expenses or losses you may incur as a result of change or cancellation. In no case will we pay compensation if accommodation is offered by us and accepted by you with a higher price than that originally booked in the same location where no additional payment is made by you.

You must notify us of your choice within 7 days of our offer. If we do not hear from you within 7 days, we will contact you again to request notification of your choice. If you fail to respond again we will assume that you have chosen to accept the alternative booking arrangements. 

We will not cancel your travel arrangements less than 70 days before departure, except for reasons of force majeure or failure by you to pay the final balance. In addition to a full refund of all monies paid by you, we will pay you compensation as detailed below, in the following circumstances:

(i) if, where we make a significant change, you do not accept the changed arrangements and cancel your booking;

(ii) If we cancel your booking and no alternative arrangements are available and/or we do not offer one.If we make a significant change and you do not accept the alternative arrangements or if we cancel less than 70 days before departure, we will also pay compensation as detailed:

The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

__IMPORTANT NOTE:__ 
We will not pay you compensation and the above options will not be available where:

We are forced to make a change or cancel as a result of Force Majeure (see clause 11)

-  We make an insignificant change
-  We cancel as a result of your failure to make full payment on time
-  Where the change(s) or cancellation by us arises out of alterations to the confirmed booking requested by you
-  Where we make a significant change or cancel your arrangements more than 70 days before departure

__Please note:__
Where arrangements with a higher price than the original arrangements is are offered by us and accepted by you, the difference in price will be deducted from any compensation payable. In no case will we pay compensation if accommodation is offered by us and accepted by you with a higher price than that originally booked in the same location where no additional payment is made by you.

Compensation will not be paid in respect of children staying at hotels for free and, where payable, will be paid on a pro-rata basis of the adult rate where children have received a reduced rate. Very rarely, we may be forced by force majeure (see clause 11) to change or terminate your arrangements after departure. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), pay you compensation or meet any costs or expenses you incur as a result. If we become unable to provide a significant proportion of the services that you have booked with us after you have departed, we will, if possible, make alternative arrangements for you at no extra charge and where those alternative arrangements are of a lower standard, provide you with an appropriate price reduction.

Changes to your holiday

Except where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by “Force Majeure”, meaning any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, government action; industrial dispute; lock closure; natural or other disaster; nuclear incident; terrorist activity; chemical or biological disaster; closure of airports; fire; flood; drought; re-scheduling; or cancellation of flights or alteration of the airline; or aircraft type by an airline and unavoidable technical problems and all similar events outside our or the supplier(s) concerned’s control. Brexit Implications: please note that certain travel arrangements may be affected as a result of the United Kingdom’s decision to leave the European Union. This could include an unavailability of certain flight routes, access to certain ports and airports, etc. . Please rest assured that this is something we will continue to monitor and will advise our customers as soon as possible if we become aware of any confirmed bookings that will be affected. However, since this is something which is completely unprecedented and outside our control, we would treat any such changes as Force Majeure, and whilst we will endeavour to provide suitable alternative arrangements or refunds where possible, we will not be liable to pay you any compensation.

Force Majure

Changes by Mercury Holidays

If you wish to amend your holiday you will need to contact us to do so. You can contact us by either sending an email to mybooking@mercuryholidays.com with the word amend and your booking reference in the subject line or calling us.  

All amendments/alterations will incur the following charges: 

A. Amendments made greater than ten weeks before your original departure date 

- An amendment fee of £30 per person for all destinations will be levied by us 
- Any additional costs from airlines and/or hotels. 

B. Amendments made less than ten weeks before your original departure date 

- Amendments during this period will be treated as a cancellation by you and the cancellation charges detailed in our Terms and Conditions will apply.

Can I amend my booking?

Amendment policy

Should you or any member of your party need to cancel your booking or any part of it, once it has been confirmed, you must notify us as soon as possible. You can notify us by phone, email or in writing.  

Your notice of cancellation will only take effect when it is received by us and will be effective from the date on which we receive it.  

Should one or more member of a party cancel, it may increase the per person holiday price of those still travelling and you will be liable to pay this increase.  

The charges which we will impose are set out below, and their level will depend on when we receive your written notification of cancellation. Any amendment fees, insurance premiums, airport taxes or higher level deposit paid cannot be refunded and are payable in full.  

Since we incur costs in cancelling your arrangements, you will have to pay the cancellation charges as follows:

The cancellation charges above have been calculated as a genuine pre-estimate of the losses we would incur in the event you cancelled your holiday within the stipulated time period, taking into account the charges we will incur from our suppliers (some of which will be up to 100%) and the expected cost savings and income from alternative deployment of the travel services (if possible) calculated as an average charge over a period of time. 

* Certain arrangements may not be amended after they have been confirmed and any alteration or cancellation could incur cancellation charges from your suppliers (up to 100% of booking value) in addition to the charge above. Please note that any services booked through us and supplied by Holiday Extras, Rock Insurance or Spendology are cancelled in accordance with the individual terms and conditions of those companies and could be non-refundable. Therefore, in the event of cancellation, it is possible that no refund will be given to you on that part of your booking.  

Note: cancellation charges above are shown as a percentage of holiday cost (excluding insurance premiums or amendment fees).  

Please ensure that you are in receipt of written confirmation from us of your cancellation. Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned. We will deduct the cancellation charge(s) from any monies you have already paid to us.  

Important note: Airport taxes are not refundable if your holiday is cancelled. Please be advised that if you pay a higher deposit at the time of booking, e.g. 50% of the cost of your holiday then this is a non-refundable deposit. 

For flight inclusive bookings, you must in addition pay the charges levied by the airline concerned. As most airlines do not permit name changes after tickets have been issued for any reason, these charges are likely to be the full cost of the flight.

Can I cancel my holiday?

Tickets are usually issued 7-10 days before departure and will be sent to the 'lead passenger' on the booking unless you have requested otherwise.

Most flights are either ticketed "Electronically" or "Ticketless"; in both these cases the procedure is very simple. 

Please note, if you are travelling with a low cost airline such as EasyJet, Jet 2 or Ryanair - you are required to check-in online. Once you have checked in online you will be able to download/print your baording passes, which will act as your tickets.

When will I receive my tickets?

An E-tickets is an electronical ticket for your flight. If the airline you are travelling with uses e-tickets, you will be sent the required information via email around 7-14 days before your departure date.

Although an e-ticket is an electronic ticket, we do recommend that you print a copy, just in case, as it serves as proof that your ticket was issued.

At the airport - to check in with an e-ticket you need to provide a valid passport so the airline staff can find your details in their system. The check-in agent then provides your boarding pass to take to the gate.

E-tickets or online flight tickets have replaced the previous printed versions.

What is an e-ticket?

Where an email address has been provided, a confirmation email containing your booking summary will be sent to you within 48 hours.

If you have booked through a Travel Agent please contact them directly (as they will need to forward all booking correspondence to you).

If you or a member of your party is prevented from travelling, that person may transfer their place to someone else subject to the following conditions: 

- We are notified not less than 7 days before departure; 
- Any outstanding balance payment, an amendment fee of £30 per person transferring, as well as any additional fees, charges or other costs arising from the transfer are paid; and 
- The transferee agrees to these booking conditions and all other terms of the contract between us 

If you are unable to find a replacement, cancellation charges as set out in our Terms and Conditions will apply.
